ABOUT EMPLOYER CHANGE APPLICATION TERMS AND CONDITIONS

1. The application for a change of employer involves both the original employer (releasing the employee) and the new employer (accepting the employee). Both parties must agree to the release/acceptance of foreign workers, and the document must be stamped with a revenue stamp.

3. Foreign workers in the following categories are not eligible for employer changes: 6P pass, Special Program for the Management of PATI (PKPP), Rehiring Program, Workforce Recalibration Program (RTK), any bleaching program, domestic workers, workers without a Temporary Work Visit Pass (PLKS), and PLKS holders with 10 years or more of employment.

5. Employers must ensure that the foreign worker's PLKS is valid for at least 3 months at the time of application to guarantee processing.

7. The original employer or heir (in case of the employer's death) must fully complete the employer change application form and submit the required documents to the One-Stop Center for Foreign Worker Management, Immigration Affairs Division, Ministry of Home Affairs. Incomplete or irregular applications that do not meet criteria may be rejected by KDN.

2. The new employer must be in the same sector and authorized to employ foreign workers. Sectors frozen or closed by the Government for new foreign worker recruitment are not permitted.

4. Employers must first obtain a support letter from the Peninsular Malaysia Manpower Department (JTKSM) before applying to the One-Stop Center for Foreign Worker Management at the Ministry of Home Affairs for the employer change process.

6. Approval for changing employers depends on compliance with all requirements by both the employer and the foreign worker.

8. Employers or companies submitting false information or documents may face legal action. KDN and the Malaysian Immigration Department (JIM) reserve the right to blacklist such employers/companies from applying for quotas or foreign worker pass extensions.
